Terms of service
This is the agreement between you and Ojava. It covers what the product does, what it will never do, how the free trial and billing work, and the control you keep over your own data.
What this agreement covers
These terms apply when you create an Ojava account or use the Ojava website, apps, or services. By using Ojava, you agree to them. If you do not agree, do not use the service.
Two other pages are part of this agreement and explain the same commitments in more detail: Privacy & your data describes how your records are handled, and Account & data controls describes the controls you use to consent, export, and delete.
What Ojava is, and what it will never do
Ojava is a general wellness product. It helps you bring your own health records together, understand what they mean in plain language, see how your own numbers trend over time, and prepare questions for the clinician you already see. It also helps you log food, training, sleep, and other wellness habits, and gives you direct guidance on fitness, recovery, sleep, nutrition, and healthspan.
Ojava is not a doctor and does not provide medical care. It does not diagnose a condition, prescribe or adjust medication, tell you a dose, order or interpret tests as a clinician would, refer you to a provider, bill insurance, or employ clinicians. It does not tell you that anything is medically safe for you, and it is never a reason to delay or skip care. Clinical decisions stay with your own independent clinician.
Ojava also does not monitor you. It does not watch your readings for a medical problem, does not detect a heart rhythm or a fall, and does not send a clinical alert. Nothing in the product should be treated as an emergency service.
Important
Ojava Coach is an AI feature. It works from the records you have accepted into your account and from published health information, and it can still be wrong, incomplete, or out of date. Treat what it tells you as education to discuss with a qualified professional, not as an instruction to act on.
Your account
You must be 18 or older to create an Ojava account, and you may create one only for yourself. Give accurate information when you sign up, keep your sign-in credentials private, and tell us at hello@ojava.health if you believe someone else has reached your account. You are responsible for what happens under your account.
Do not upload another person’s health records unless you have their permission or the legal authority to act for them. A Family Plan shares billing and seats only. Each member keeps a separate private account, and no member can see another member’s records.
The free trial is how you decide
Paid memberships are offered with a 7-day free trial. You are not charged during the trial. If you cancel before it ends, you pay nothing at all. The trial exists so you can use the paid features on your own records, with your own data in front of you, and decide whether the membership is worth paying for before any money changes hands.
This matters for the refund policy below, so it is worth being direct about it: the trial is the point at which you try Ojava and decide. Use it. If Ojava is not right for you, cancel inside those 7 days and there is nothing to refund.
The Free plan needs no card and no trial clock. It stays usable on its own.
Payment, renewal, and cancellation
Paid memberships are billed through Stripe, monthly or annually depending on the option you choose. Ojava does not store your card number. A membership renews automatically at the end of each billing period, at the price shown when you subscribed, until you cancel. If a price changes, we will tell you before the change takes effect on your membership.
You can cancel at any time. Settings opens Stripe billing, where payment methods, invoices, plan changes, and cancellation are handled. Cancelling stops the next renewal. You keep access for the rest of the period you have already paid for, and the membership then ends.
Add-ons are billed the same way and can be cancelled the same way. A one-time purchase is charged once and is not a subscription.
Ojava does not bill insurance and does not claim HSA or FSA eligibility. What each plan includes is on the Pricing & plans page.
Refunds
Ojava does not give refunds. That is the whole reason the free trial exists. You get 7 days to use the paid features against your own data and decide, before you are charged anything.
So when you cancel, your membership runs to the end of the period you already paid for and then stops renewing. There is no partial refund for the unused part of a month or a year, and add-ons and one-time purchases are not refundable either. Where a law requires a refund, Ojava follows that law.
If you buy an Ojava membership through an app store rather than through Ojava directly, that store handles the payment and its own refund rules apply to that purchase. Ojava cannot grant, deny, or override a refund decision that belongs to the store. Take a store refund question to the store.
Your data, your consent, your control
You keep ownership of the records, photos, logs, and notes you bring into Ojava. You give Ojava the permission it needs to store that content, process it, and show it back to you so the features you asked for can run. That permission exists to operate the service for you, and it ends when you delete the content or your account.
Consent is recorded per purpose and is reversible. Authorizing an import, holding results in review until you accept them, and any optional sharing are separate choices, not one blanket agreement, and you can withdraw any of them from Settings. Ojava works only from records you choose to bring in.
Imported results wait in a review queue until you accept them. Only accepted results become part of your record and become visible to Ojava Coach.
You can export your data at any time as a standards-compliant FHIR file or as CSV spreadsheets, and you can delete your account and everything in it. Account deletion runs immediately and cannot be undone. These are real controls in Settings, described on Exports & sharing and Account & data controls.
Your health data is not sold and is not used for advertising. Records Ojava recognizes as sensitive, covering mental and behavioral health, substance-use treatment, reproductive and sexual health, genetic, and HIV-related information, are withheld from exports, shared links, and Ojava Coach unless you opt in for that specific action.
How food photos are used, and nothing else
Ojava does not use your health data to train models, with one exception, and it belongs in plain sight rather than in a footnote.
Food photos are the exception. When you submit a photo to scan a meal or a nutrition label, that photo may be used to improve Ojava’s food-recognition feature, so that scanning a plate of food keeps getting more accurate for everyone using it.
Every other category is never used to train any model, under any circumstance: lab results, imaging, medical records, medications and supplements, wearable readings, symptom, mood and cycle logs, body metrics, your notes, and your conversations with Ojava Coach. There is no setting that quietly changes this, and there is no exception buried elsewhere.
Ojava is not a HIPAA covered entity
HIPAA governs health plans, health care clearinghouses, and health care providers who bill electronically, along with the vendors who handle protected health information for them. Ojava is none of those. It does not provide clinical care and does not bill insurance, so it is not a HIPAA covered entity and the records you keep here are not HIPAA-covered records.
That is a statement of what the law does, not a gap in how your data is treated. Your records are still governed by this agreement, by the commitments on the Privacy & your data page, and by the consumer privacy laws that apply to you, including Washington’s My Health My Data Act. A copy of a record held by your own clinician or insurer stays covered by their obligations, whatever you do with your copy in Ojava.
How you may use Ojava
Use Ojava for your own wellness and your own records. Do not:
- use it to diagnose, treat, or make a clinical decision for yourself or anyone else
- upload records belonging to another person without their permission or your legal authority to act for them
- present Ojava output as the advice of a clinician, or resell it as a clinical service
- copy, scrape, reverse-engineer, or resell any part of the service
- attempt to reach another person’s account or data, or work around any security or access control
- upload malicious code, or use the service in a way that disrupts it for other people
- use the service in a way that breaks the law
Services Ojava relies on
Ojava uses a small number of outside services to work: Stripe for payments, an AI model provider to generate Coach responses, and the wearable, app, and record sources you choose to connect. When you connect one of those sources, you are also agreeing to that company’s own terms with them, and what they do with your data on their side is governed by their policies. Ojava sends a model provider only the minimum context needed to answer what you asked, and provider-side storage of those requests is disabled.
Availability and changes to the service
Ojava is offered as it is. We do not promise the service will be uninterrupted, error-free, or available at a particular moment, and features can change, be added, or be removed as the product develops. If we remove something you rely on, your export and deletion controls stay available so you can take your data with you.
Ending your account
You can close your account at any time from Settings, which deletes your account and the records in it. Ojava may suspend or end an account that breaks this agreement, that is used to harm another person, or where the law requires it. If we end your account, you can still ask for a copy of your data, unless the law prevents it.
Disclaimers
Ojava is provided on an as-is and as-available basis, without warranties of any kind, to the extent the law allows. That includes any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
Health information in Ojava, including anything Ojava Coach tells you, any trend it shows, and any number it calculates, is educational. It can be incomplete or wrong, it does not account for everything about you, and it is not a medical opinion. You are responsible for the decisions you make about your own health, and for confirming them with a qualified professional.
Limits on liability
To the extent the law allows, Ojava is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunity, arising from your use of the service. Ojava’s total liability for any claim relating to the service is limited to the amount you paid Ojava in the 12 months before the claim arose.
Some places do not allow these limits. Where that is true, they apply only as far as that law permits, and nothing here removes a right you have that cannot be waived.
Changes to these terms
These terms can change as the product changes. The version on this page is the one that applies, and an updated version replaces this one here. If a change materially affects your rights, we will give notice before it takes effect. Continuing to use Ojava after a change means you accept the updated terms.
